Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and Qadam ("we", "our", "us") governing your access to and use of the Qadam mobile application and website (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

• You must be at least 6 years of age to use Qadam.
• Users under the age of 18 must use the app under the supervision and with the consent of a parent or legal guardian.
• By using the Service, you represent that you meet these eligibility requirements.
• We reserve the right to terminate accounts that we reasonably believe are in violation of these eligibility requirements.

3. Accounts

• You may create one account per person. Multiple accounts by the same individual are not permitted.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must provide accurate, current, and complete information when creating your account. You agree to update your information to keep it accurate.
• You must notify us immediately at vahdevelopment@gmail.com if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate your account if we believe it has been compromised or used in violation of these Terms.

4. Family Groups

• A family group may have a maximum of 6 members, including the Family Head (creator).
• The Family Head is responsible for managing the group, accepting or rejecting join requests, and claiming monthly rewards on behalf of the family.
• Members may leave a family group at any time. The Family Head may remove members at any time.
• If a user leaves or is removed from a family, a cooldown period applies before they can join a new family (until midnight of the same day).
• The Family Head may delete the family group entirely. Doing so removes all members and forfeits any pending monthly reward.
• Family names must be unique and may not contain offensive, harmful, or misleading content.

5. Step Tracking

• Step counts are recorded using the device's built-in pedometer sensor. Qadam does not independently verify step counts.
• You agree to use the app honestly and not to manipulate, falsify, or artificially inflate your step count by any means, including but not limited to mechanical devices, automated scripts, shaking the device, or any other deceptive method.
• Steps must be logged manually for each day within the app. Qadam does not automatically sync step data in the background.
• Historical step data cannot be retroactively edited or adjusted.

6. Rewards and Coupons

The Qadam reward system is governed separately by our Coupon & Reward Policy, which is incorporated into these Terms by reference. Key points:

• Rewards are earned collectively by the family group, not by individual users.
• Rewards are subject to availability and may be modified, suspended, or discontinued at any time.
• Fraudulent activity to gain rewards is grounds for immediate account termination without notice.
• Coupon codes are for personal use only and may not be resold, transferred, or exchanged for cash.

7. Prohibited Conduct

You agree not to:

• Falsify, manipulate, or artificially inflate step data to qualify for rewards.
• Create multiple accounts to gain unfair advantages.
• Use the Service for any unlawful purpose or in violation of applicable laws.
• Harass, abuse, or harm other users through the app's messaging or nudge features.
• Attempt to gain unauthorised access to our systems, servers, or databases.
• Use automated tools, bots, or scripts to interact with the Service.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service in any way that could damage, disable, or impair the app or its servers.
• Misrepresent your identity, affiliation, or relationship with any person or organisation.

8. Intellectual Property

All content, design, graphics, logos, and software comprising the Service are the property of Qadam and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our express written permission.

The name "Qadam," the Qadam logo, and related marks are trademarks of Qadam. Nothing in these Terms grants you any right to use these marks.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content or information on the Service.

Qadam is a fitness tracking app and does not provide medical advice. The step count data and activity information within the app are for motivational and informational purposes only. Always consult a qualified healthcare professional before starting any new physical activity programme.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Qadam, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or loss of rewards arising from:

• Your use of or inability to use the Service.
• Unauthorised access to or alteration of your data.
• Any bugs, errors, viruses, or other harmful components.
• Any failure to receive a reward or coupon due to technical issues.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed ₹500 (Indian Rupees five hundred).

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or if continuation of your account poses a risk to other users or the integrity of the Service.

You may delete your account at any time via Settings → Delete Account within the app. Upon deletion, your data will be removed within 30 days in accordance with our Privacy Policy.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the Effective Date and, where material changes are made, notify you via an in-app notice. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through friendly negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Coupon & Reward Policy, constitute the entire agreement between you and Qadam regarding your use of the Service and supersede all prior agreements and understandings.
